CONSTITUTION OF
THE ASSOCIATED STUDENT BODY OF
CAPISTRANO VALLEY HIGH SCHOOL
PREAMBLE
We, the students of Capistrano Valley High School, in order to establish, promote, and uphold the democratic, academic and social principles of this school, do hereby order and establish this constitution.
ARTICLE I: NAME
The name of this organization shall be the Associated Student Body of Capistrano Valley High School, residing at 26301 Escolar, Mission Viejo, California, 92692.
ARTICLE II: ADMINISTRATIVE ORGANIZATION
SECTION 1. (AUTHORITY) Every activity of the Associated Student Body shall be conducted under the jurisdiction of the ASB Cabinet, the Principal and his designee, the Director of Student Activities. Further, the ASB Cabinet, the Principal and his designee shall be directly responsible to the advice and consent of the Board of Trustees of the Capistrano Valley High School District.
Section 2. (MEMBERSHIP) Any student enrolled at the Capistrano Valley High School will be considered to be a member of the Associated Student Body and shall have all privileges and rights as outlined in this Constitution.
All active members of the organization shall have the right to hold office, participate in all activities, and vote in elections and conventions, unless otherwise specified in the By-Laws.
All active members of the organization shall receive and shall possess official identification cards issued by the organization.
SECTION 3. (TRADITIONS)
A. The official colors of Capistrano Valley High School shall be black and gold.
B. The official mascot of Capistrano Valley High School shall be the "Cougars".
C. The official newspaper of Capistrano Valley High School shall be named "CVHS Times".
D. The official title of the yearbook of Capistrano Valley High School shall be "El Gato".
E. These names conducted vote of the currently enrolled students at Capistrano Valley High School. Only a two-thirds majority (66%) shall be sufficient to cause a change in any of the aforementioned of Capistrano Valley High School.
ARTICLE III: OBJECTIVES
The objectives of the ASB Cabinet shall be to:
1. Provide a democratic forum in which students may address those school-related issues which affect their lives.
2. Maintain a continuous communication channel from the students to both faculty and administration, as well as among the students within the school.
3. Offer a year-long program of social functions and community involvement projects for students.
4. Train students in the duties and responsibilities of good citizenship, using the school environment as the primary training ground.
ARTICLE IV: LEADERSHIP ORGANIZATION
SECTION 1. (MEMBERSHIP) The student cabinet/council shall consist of all duly elected and appointed associated Student Body officers and the four class presidents and vice-presidents.
SECTION 2. (POWERS) The ASB Cabinet shall have executive, legislative, and judicial powers.
The ASB Cabinet shall have the power to propose and pass all legislation, including expenditures.
The ASB Cabinet shall have the power to regulate all facets of the student activities program.
SECTION 3. (MEMBERS OF THE ASB CABINET) The members of the ASB Cabinet shall consist of the following officers:

Freshman Class President/VP/Representative
All commissioner positions and Senior Class Representative shall be appointed by the current ASB President, the newly elected ASB Executive Council in conjunction with the Director, Student Activities and the previous commissioners holding said positions. All other members shall be elected officers.
SECTION 4 (DUTIES AND QUALIFICATIONS OF CABINET OFFICERS)
The following shall be the duties and qualifications of the officers, appointed and elected to the ASB Cabinet
A. ASSOCIATED STUDENT BODY PRESIDENT
President is in charge of all Student Government functions.
1. Qualifications
a. The President shall be at least a member of the Junior Class.
b. The President shall maintain a 2.5 grade point average with no "F's" or "U's" on
the semester report card prior to the assumption of the office.
c. The President shall conform to the ASB Cabinet Code of Conduct as
enumerated in Article 5.
d. The President must have one year of previous Capistrano Valley High School ASB experience.
2. Duties
a. Act as the first citizen of Capistrano Valley High School.
b. Act as chairperson of all ASB business meetings and, with the ASB Secretary
and Director, Student Activities, create all meeting agendas.
c. Maintain order among the ASB Cabinet, assisting with evaluation of each
member's performance in the execution of their office.
d. Organize and chair committees assigned out to the ASB Cabinet.
e. Assist any other ASB office in need of support to insure that the assigned
task will be completed on time and in proper fashion.
f. Assist with the organization of the House of Representatives.
- Serve as Master of Ceremonies for all ASB assemblies and meetings
- Work closely with the faculty and administration in designing and
implementing ways to enhance the academic and co-curricular of the school
i. Work closely with the Director, Student Activities to maximize the quality of
student life at Capistrano Valley High School.
j. Voice student concerns to the faculty and administration and attempt to
develop programs and policies that will address the concerns.
k. Attend all ASB sponsored activities and function as a responsible leader at
these events.
l. Work closely with ASB Secretary in coordinating meetings which will be held
on a regular and timely basis.
- Assist VP with organization of all elections.
- Serve as a member of the ASB Cabinet.
o. Personally oversee the Commissioners of Activities and the Commissioners of Pep to provide them specific tasks, ideas, assistance, and accountability.
p. Discuss the undertakings of the Commissioners of Activities and the Commissioners of Pep to the Executive Board every week.
B. ASSOCIATED STUDENT BODY VICE-PRESIDENT
1. Qualifications
a. The Vice-President shall be a member of at least the Junior Class.
b. The Vice-President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Vice-President shall conform to the ASB Code of Conduct as enumerated in
Article 5.
d. The Vice-President must have one year of previous Capistrano Valley High School ASB experience.
2. Duties
a. Assist the ASB President in the execution of his duties.
b. Be prepared to assume the duties of the ASB President at any time.
c. Assume some of the ASB President's duties of the ASB President at any time.
d. Serve as the President of the House of Representatives and chair all of its meetings.
e. Organize all elections.
f. Attend all ASB sponsored activities and function as a responsible leader at these events.
- Perform other duties as assigned by the ASB President or the Director, Student Activities.
- Serve as a member of the ASB Cabinet.
- Personally oversee the Commissioners of Multicultural and the Commissioners of Campus/Student Services to provide them specific tasks, ideas, assistance, and accountability.
- Discuss the undertakings of the Commissioners of Multicultural and the Commissioners of Campus/Student Services to the Executive Board every week.
C. ASSOCIATED STUDENT BODY SECRETARY
1. Qualifications
a. The Secretary shall be at least a member of the Junior Class.
b. The Secretary shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Secretary shall conform to the ASB Code of Conduct as enumerated in Article 5.
d. The Secretary must have one year of previous Capistrano Valley High School ASB experience.
2. Duties
a. Create, in conjunction with the ASB President and the Director, Student Activities, the meeting agenda for each ASB business meeting.
b. Maintain the minutes of each ASB business meeting and insure that the minutes accurately precise exactly what occurred at each meeting.
c. Maintain a notebook with all ASB Agendas, Minutes, P.R's and checks and insure that the ASB Financial Secretary receives copy of each set for each meeting.
d. Work with the ASB Vice-Presidents as the recorder for all House of Representatives meetings.
e. Maintain all correspondence for the ASB Cabinet as necessary to include Holiday Cards, Thank You notes and other memoranda and business notes.
f. Insure at all times that communications among ASB Cabinet Officers is at a maximum level of performance.
g. Act as a training resource for all class representatives.
h. Attend all ASB sponsored activities and function as a responsible leader at these events.
i. Perform other duties as assigned by the ASB President or the Director, Student Activities.
j. Attend executive committee meetings of the Parent-Teacher-Student
atmosphere of the school.
- Personally oversee the Commissioners of Athletics and the Commissioners of Publicity to provide them specific tasks, ideas, assistance, and accountability.
- Serve as a member of the ASB Cabinet.
- Discuss the undertakings of the Commissioners of Athletics and the Commissioners of Publicity to the Executive Board every week.
- Preserve the ASB Secrets under the title of Keeper of ASB Secrets
D. ASSOCIATED STUDENT BODY TREASURER
1. Qualifications
a. The Treasurer shall be at least a member of the Junior Class the semester prior to the assumption of office.
b. The Treasurer shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Treasurer shall conform to the ASB Code of Conduct as enumerated in Article 5.
d. The Treasurer must have one year of previous Capistrano Valley High School ASB experience.
2. Duties
a. Prepare, annually, the ASB budget in conjunction with the ASB President, the Director, Student Activities, and the Student Activities Accounts Clerk.
b. Maintain and periodically update for ASB Cabinet edification, the ASB Budget.
c. Maintain a record of all disbursements read and approved by ASB Cabinet.
d. Issue periodically financial statements to the active campus clubs regarding their financial status.
e. Attend all ASB sponsored activities and function as a responsible leader at these events.
- Perform other duties as assigned by the ASB President or the Director, Student Activities.
- Train all Commissioners of Technical Services and Class Representatives to operate the Activities Office Registers.
- Serve as a member of the ASB Cabinet.
- Personally oversee the Commissioners of Technology and the Class Representatives to provide them specific tasks, ideas, assistance, and accountability.
- Discuss the undertakings of the Commissioners of Technical Services and the Class Councils to the Executive Board every week.
E. ASSOCIATED STUDENT BODY COMMISSIONER OF ACTIVITIES (2 members)
1. Qualifications
a. The Commissioner's of Activities shall be at least members of the current Sophomore class.
b. Then Commissioner's of Activities shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Commissioner's of Activities shall conform to the ASB Code of Conduct as enumerated in Article 5.
2. Duties
a. Supervise the complete organizational structure of all ASB sponsored dances, including the Homecoming Dance, Winter Formal and Prom.
b. Supervise the complete organizational structure of Air Guitar.
c. Supervise the complete organizational structure of all activities, excluding pep rallies.
d. Supervise the complete organizational structure of all other ASB sponsored events as designated by the Cabinet.
- Work closely with the Commissioner's of Technical Services, Pep and Publicity to insure that all ASB special events receive the proper support services.
- Serve as a member of the ASB Cabinet.
g. Attend all ASB sponsored activities and function as a responsible leader at these events.
h. Perform other duties assigned by the ASB President or the Director, Student Activities.
F. ASSOCIATED STUDENT BODY COMMISSIONER OF ATHLETICS (2 members)
1. Qualifications
a The Commissioner of Athletics shall be at least a member of the current Sophomore class.
b The Commissioner of Athletics shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Commissioner of Athletics shall conform to the ASB Code of Conduct as enumerated in Article 5.
2. Duties
a. Serve as the representative of the Athletic Department to the ASB Cabinet.
b. Work closely with the Director of Athletics.
- Produce all bulletin notices that relate to athletics.
- Construct a monthly calendar of Athletics activities for both student and ASB edification.
- Create a selection process for the "Athlete of the Month."
- Insure that the awards program demonstrates an even distribution between the men and the women's athletic departments.
- Insure that the "Athlete of the Month" program receives media recognition, both in the school newspaper and other local newspapers.
- Work closely with Commissioner's of Publicity to insure proper monthly recognition.
- Organize the yearly Dodgeball event and all other ASB-sponsored sports tournaments.
- Coordinate the publicity and selection of the CVHS “Game of the Week”.
- Serve as a member of the ASB Cabinet.
- Attend all ASB sponsored activities and functions as a responsible leader at all these events.
- Perform other duties as assigned by the President or the Director, Student Activities.
G. ASSOCIATED STUDENT BODY COMMISSIONERS OF CAMPUS/STUDENT SERVICES (2 members)
1. Qualifications
a. The Commissioner's of Campus Service shall be at least members of the current Sophomore class.
b. The Commissioner's of Campus Service shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Commissioner's of Campus Service shall conform to the ASB Code of conduct as enumerated in Article 5.
2. Duties
- Design a method of maintaining a clean campus daily, such as the ASB “Campus Clean-Up Crew”
- Plan monthly campus clean-up events that are open to the entire student body, but can also provide credit toward unserved discipline hours.
b. Organize and maintain the "Student of the Month" program for one male and one female per month.
c. Create one major campus environmental/beautification improvement project per semester.
d. Organize all Cabinet hospitality functions.
e. Organize all Freshman and New Student Orientation, Faculty/Staff Appreciation Activities.
f. Organize Harvest Bank, Blood Drives, and other on-campus charitable events.
g. Organize the Spirit of the Cougar recognition event every semester.
- Work closely with Commissioner's of Publicity to insure proper promotion.
- Serve as a member of the ASB Cabinet.
- Attend all ASB sponsored activities and functions as a responsible leader at all these events.
- Perform other duties as assigned by the President or the Director, Student Activities.
J. ASSOCIATED STUDENT BODY COMMISSIONER OF CLUBS (2 members)
1. Qualifications
a. The Commissioner's of Clubs shall be at least members of the current Sophomore Class.
b. The Commissioner's of Clubs shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report care prior to the assumption of office.
c. The Commissioner's of Clubs shall conform to the ASB Code of Conduct as enumerated in Article 5.
2. Duties
- Serve as the ASB liaison with all campus clubs.
- Work closely with campus clubs to be kept abreast of their activities.
c. Conduct monthly meetings with club presidents by chairing the Inter-Club Council.
d. Conduct monthly round table discussions (Multicultural Round Table).
- Chair the Multicultural Faire.
- Organize Multicultural.Week.
- Organize the multicultural dance when approved by the ASB.
- Supervise Asian and Latino Appreciation weeks (and any other ethnic recognition) in cooperation with ethnic campus clubs.
- Select a culture group to honor every month through activities and announcements for the general edification of the student body.
- Serve as a member of the ASB Cabinet.
- Attend all ASB sponsored activities and functions as a responsible leader at those events.
- Perform other duties as assigned by the ASB President or the Director of Student Activities.
H. ASSOCIATED STUDENT BODY COMMISSIONER OF PEP (2 members)
1. Qualifications
a. The Commissioner's of Pep shall be at least members of the current Sophomore Class.
b. The Commissioner's of Pep shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Commissioner of Pep shall conform to the ASB Code of Conduct as enumerated in Article 5.
2. Duties
- Supervise the structural organization and execution of all Pep Rallies during Special Assembly periods or at Lunchtime Rallies.
- Work closely with Class Councils to produce weekly Lunchtime Activities for the student body.
- Construct one Spirit Week per sport season/major dance, as well as any other Spirit Weeks deemed acceptable by the ASB.
- Supervise the structural organization and execution of yearly Class Competition events in conjunction with the Class Councils.
- Serve as a member of the ASB Cabinet.
- Attend all ASB sponsored activities and functions as a responsible leader at all these events.
- Perform other duties as assigned by the President or the Director, Student Activities.
I. ASSOCIATED STUDENT BODY COMMISSIONER OF TECHNICAL
SERVICES (3-5 members)
1. Qualifications
a. The Commissioner's of Technical Service shall be at least members of the current Sophomore Class.
b. The Commissioner's of Technical Service shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. The Commissioner's of Technical Service shall conform to the ASB Code of Conduct as enumerated in Article 5.
2. Duties
a. Demonstrate a high degree of responsibility and diligence in the utilization of technological equipment.
b. Demonstrate knowledge of electronic, lighting and sound equipment to be utilized by the ASB.
c. Create all necessary lighting and sound electronic scenarios for all ASB events, including elections and sporting events.
d. Supervise electronic, light and sound equipment utilization at all ASB functions.
e. Maintain all ASB electronic, light and sound equipment.
f. Provide a report of the condition and the inventory of all technological equipment owned by the ASB at the end of each semester.
g. Work all ASB functions that require technical assistance.
- Create videos for promotion of ASB events.
- Operate the Activities Office Registers whenever major ASB-sponsored event tickets, ASB-sponsored products, or other items are sold at lunch.
- The appointed Head Tech shall oversee the other Commissioners of Technical Services, their duties, obligations, and weekly commitments.
i. The appointed Head Tech shall serve as a liaison between ASB and Video Production class.
- Videotaping of all ASB functions.
- Assist the Commissioners of Activities with all equipment and other technical services required at ASB functions.
- Serve as a member of the ASB Cabinet.
m. Perform other duties as assigned by the ASB President and Director, Student Activities.
L. ASSOCIATED STUDENT BODY COMMISSIONER OF PUBLICITY (2-3 members)
1. Qualifications
a. The Commissioner's of Publicity shall be at least members of the current Sophomore Class.
b. The Commissioners of Publicity shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
c. Then Commissioner's of Publicity shall conform to the ASB Code of Conduct as enumerated in Article 5.
2. Duties
a. Create and display publicity posters for all ASB especial events and athletic events.
b. Maintain the ASB window and display case.
c. Read daily announcements over Public Address system (Only announcements with prior approval by an administrator).
d. Create all necessary publicity through print, posters, emails, online announcements, and any other means necessary for ASB special events.
- Write all pertinent bulletin notices publicizing ASB events.
- The appointed Webmaster shall oversee the ASB website and frequently update the online school website to publicize all ASB-related functions.
- Serve as a member of the ASB Cabinet.
- Attend all ASB sponsored activities and function as a responsible leader of these events.
- Perform other duties as assigned by the ASB President or the Director, Student Activities.
SECTION 5. (Members of Class Councils) The member of the four class councils shall consist of the following elected class officers:

SECTION 6. (Duties and Qualifications of Class Councils) The following shall be the duties and qualifications of the elected officers of the Freshman, Sophomore, Junior and Senior classes.
A. SENIOR CLASS COUNCIL
1. SENIOR CLASS PRESIDENT
a. Qualifications
1. The Senior Class President shall be a member of the current Senior Class.
2. The Senior Class President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Senior Class President shall conform to the ASB Code of conduct as enumerated in Article 5.
b. Duties
1. Serve as the chief citizen of the Senior Class.
2. Serve as the master of Ceremonies at all Senior Class functions.
3. Construct a master calendar of all Senior Activities for the ASB in order to accordingly plan and publicize all Senior Activities.
4. Supervise the members of the Senior Class Council as they conduct the duties associated with their office.
5. Supervise the organizational structure and the selection of the selection of the Senior Picnic.
6. Supervise the selection process and the selection of the Senior Class Gift.
7. Supervise the organizational structure and the execution of the Senior Luncheon.
8. Assist with the construction of the Senior Slide Show.
9. Serve as a member of the ASB Cabinet.
10. Attend all Senior Class and ASB sponsored activities and function as a responsible leader at these events.
11. Perform other duties as assigned by the ASB President and the Director, Student Activities.
12. Shall call Senior Class meeting regularly (at least once a month).
13. Organize class reunions.
2. SENIOR CLASS VICE-PRESIDENT
a. Qualifications
1. The Senior Class Vice-President shall be a member of the current Senior Class.
2. The Senior Class Vice-President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Senior Class Vice-President shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
1. Work directly with the Senior Class President to assist in the execution of his/her duties.
2. Act as the Senior Class President should that person be unavailable.
3. Serve as a member of the ASB Cabinet.
4. Assist in the selection process and the execution of the Senior Picnic.
5. Assist in the selection of the Senior Class Gift.
- Organize and produce the Senior Slide Show.
- Work closely with the Commissioners of Pep to produce weekly Lunchtime Activities for the student body.
- Attend all Senior Class and ASB activities and function as a responsible leader at these events.
- Perform other duties as assigned by the Senior Class President or the Director, Student Activities.
3. SENIOR CLASS REPRESENTATIVE
a. Qualifications
1. The Senior Class Representative shall be a member of the current Senior Class.
2. The Senior Class Representative shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Senior Class Representative shall conform to the ASB Code of Conduct as enumerated in Article 5.
4. The Senior Class Representative will be appointed through an interview process.
b. Duties
- Serve as Photo Historian of the Senior class
- Maintain minutes of each class meeting and insure that the minutes accurately reflect precisely that which occurred at each meeting.
3. Submit monthly meeting minutes to the Director, Student Activities.
- Assist the Senior Class President in the construction of the class calendar and all other events as necessary.
- Prepare, annually, the class budget in conjunction with the President and the Class Advisor.
- Maintain and periodically update for class council edification, the class budget.
- Maintain a record of all disbursements read and approved by the class council.
- Supervise the accounting for cash on hand at all class-sponsored activities such as dances.
- Attend all House of Representative Meetings to act as a liaison between Senior classroom representatives and the Senior Class Council.
- Operate the Activities Office Registers whenever major ASB-sponsored event tickets, ASB-sponsored products, or other items are sold at lunch.
- Serve as a member of the ASB Cabinet.
- Attend all Senior Class and ASB activities and function as a responsible leader at each event.
- Perform other duties as assigned by the Senior Class President or the Director, Student Activities.
B. JUNIOR CLASS COUNCIL
1. JUNIOR CLASS PRESIDENT
a. Qualifications
1. The Junior Class President shall be a member of the current Junior Class.
2. The Junior Class President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Junior Class President shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
1. Serve as the chief citizen of the Junior Class.
2. Serve as the Master of Ceremonies at all Junior Class functions.
3. Serve as a member of the ASB Cabinet.
4. Chair all meetings of the Class Council.
5. Supervise the members of the Junior Class Council in the conduct of their respective duties.
6. Assist with the Commissioner's of Activities in the planning of the Junior-Senior Prom.
7. Develop activities especially designed for the Junior Class.
8. Create fundraisers to develop a class revenue.
9. Attend all Junior Class sponsored activities and function as a responsible leader at these events.
10. Perform other duties as assigned by the ASB President and the Director, Student Activities.
11. Shall call Junior Class Council meetings regularly (at least once a month).
2. JUNIOR CLASS VICE-PRESIDENT
a. Qualifications
1. The Junior Class Vice-President shall be a member of the current Junior class.
2. The Junior Class Vice-President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Junior Class Vice-President shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
1. Work directly with the Junior Class President to assist in the execution of his/her duties.
- Act as Junior Class President should that person be unavailable and assume all duties as necessary.
- Work closely with the Commissioners of Pep to produce weekly Lunchtime Activities for the student body.
- Serve as a member of the ASB Cabinet.
- Attend all Junior Class and ASB sponsored activities and function as a responsible leader at these events.
- Perform other duties as assigned by the Junior Class President and the Director, Student Activities.
3. JUNIOR CLASS REPRESENTATIVE
a. Qualifications
1. The Junior Class Representative shall be a member of the current Senior Class.
2. The Junior Class Representative shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Junior Class Representative shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
- Serve as Photo Historian of the Junior class.
- Maintain minutes of each class meeting and insure that the minutes accurately reflect precisely that which occurred at each meeting.

C. SOPHOMORE CLASS COUNCIL
1. SOPHOMORE CLASS PRESIDENT
a. Qualifications
1. The Sophomore Class President shall be a member of the current Sophomore Class.
2. The Sophomore Class President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Sophomore Class President shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
1. Serve as the chief citizen of the Sophomore Class.
2. Serve as the Master of Ceremonies at all Sophomore Class functions.
3. Serve as a member of the ASB Cabinet.
4. Chair all meetings of the class council.
5. Develop activities especially designed for the Sophomore Class.
6. Create fundraisers designed to develop a class revenue.
7. Attend all class-sponsored activities and function as a responsible leader at these events.
8. Perform other duties as assigned by the ASB.
9. Shall call Sophomore Class council meetings regularly (at least once a month).
2. SOPHOMORE CLASS VICE-PRESIDENT
a. Qualifications
1. The Sophomore Class Vice-President shall be a member of the current Sophomore Class.
2. The Sophomore Class Vice-President shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Sophomore Class Vice-President shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
1. Work directly with the Sophomore Class President to assist in the execution of his/her duties.
2. Act as Sophomore Class President should that person be unavailable and assume all duties as necessary.
- Serve as a member of the ASB Cabinet.
- Work closely with the Commissioners of Pep to produce weekly Lunchtime Activities for the student body.
- Attend all Sophomore Class and ASB sponsored activities and function as a responsible leader at these events.
- Perform other duties as assigned by the Sophomore Class President or the Director, Student Activities.
3. SOPHOMORE CLASS REPRESENTATIVE
a. Qualifications
1. The Sophomore Class Representative shall be a member of the current Senior Class.
2. The Sophomore Class Representative shall maintain a 2.5 grade point average with no "F's" or "U's" on the semester report card prior to the assumption of office.
3. The Sophomore Class Representative shall conform to the ASB Code of Conduct as enumerated in Article 5.
b. Duties
- Serve as Photo Historian of the Sophomore class.
- Maintain minutes of each class meeting and insure that the minutes accurately reflect precisely that which occurred at each meeting.
3. Submit monthly meeting minutes to the Director, Student Activities.
- Assist the Sophomore Class President in the construction of the class calendar and all other events as necessary.
- Prepare, annually, the class budget in conjunction with the President and the Class Advisor.
- Maintain and periodically update for class council edification, the class budget.

ARTICLE V: CODE OF CONDUCT
SECTION 1. (AUTHORITY) The Code of Conduct is established to provide officers with guidelines regarding their behavior while holding a student body or class office at Capistrano Valley High School.
SECTION 2. (ACADEMIC ACHIEVEMENT) All Student body and class officers shall maintain a 2.5 grade point average computed on a 4-point scale. Additionally, a student may not have an "F" or "U" on that report card. If an officer fails to achieve either of these standards for a semester, the officer shall be suspended from office for the next semester. Failure to maintain these standards for two consecutive semesters will result in dismissal from office.
SECTION 3. (BEHAVIORAL STANDARDS) All student body and class officers will abide by the school dress regulations at all times. No officer will carry or use chemical substances or stimulants on campus or at all school-related activities. As an officer, each individual's behavior shall abide by the CVHS Vandalism Policy. All officers shall display good sportsmanship to all to other schools, realizing that each is an ambassador for Capistrano Valley High School to these other schools. Each officer shall maintain a satisfactory citizenship record including no more than 3 truants per semester; nor shall the student be suspended from school for any reason. Should an officer violate any of the aforementioned behaviors, punishment will be at the discretion of the Director, Student Activities.
SECTION 4. (RESPONSIBILITIES OF OFFICE) All cabinet level officers shall be responsible for mandatory attendance at the formal meeting each week. (A valid readmit is the only acceptable excuse--four unexcused absences per quarter will result in the termination of office.) Each officer shall be at task on projects assigned to that officer during work periods. Each officer shall be enrolled in the student leadership course in order to maintain that officer's tenure in office. Each officer shall be held responsible for all duties enumerated in the ASB Constitution regarding that office. Each office shall, on occasion be assigned tasks that have no bearing on the office held and it shall be that officer's responsibility to carry them out to the best of that officers' ability. An officer may be dismissed from office for failing to regularly complete assigned tasks or insubordination.
ARTICLE VI: THE HOUSE OF REPRESENTATIVES
SECTION 1. (AUTHORITY) Each semester the ASB Cabinet shall establish a House of Representatives based on one member from each Class per target period designated by the ASB Cabinet.
SECTION 2 (PURPOSE) The House of Representatives shall act primarily as a communications medium with the student body at large.
SECTION 3 (POWERS) The House shall not have the power to initiate legislation affecting the student body.
SECTION 4. (LEADERSHIP) The House of Representatives shall have as its leader a Speaker of the House. The Speaker of the House shall be the current ASB Vice-President.
SECTION 5. (ELECTION) Each semester the Speaker shall contact the faculty and call for the popular election of one student and an alternate from one of their classes during the period on which Student government is held.
SECTION 6. (MEETING) The House shall be called into session regularly, once a month. The meeting agenda shall consist of three divisions: information items, discussion items and items from the floor.
AMENDMENTS TO
THE CONSTITUTION OF
THE ASSOCIATED STUDENT BODY OF
CAPISTRANO VALLEY HIGH SCHOOL
Amendment I
Priorto the ASB Elections, candidates will be required to go through a qualifying/screening process of their petitions/applications. The petition/application will consist of : (1) three teachers signatures/ recommendations, (2) fifteen student signatures/recommendations, (3) list of student's activities (4) selection of office petitioning for, (5) grade point verification by school administrator, (6) signing form releasing academic and disciplinary records for review, releasing Capistrano Unified School District, Capistrano Valley High School, and any of its faculty, students, and administrators from legal action, (7) signed form agreeing to the Capistrano Valley High School Code of Conduct. The candidates are subject to full academic and disciplinary review. This may range from teacher/faculty input, review of transcripts, and/or conferences with the Principal, Assistant Principal, or other relevant classified staff. Interviewees and their parents will sign to agree with set terms of the petition process.
The Director, Student Activities, in conjunction with the ASB Vice-President, will devise and develop a rubric to be used as part of the screening process. Those students passing the screening test will qualify to participate in campaign week and deliver his/her speech on the day of ASB elections. (Article VII)
Amendment II
Section 1. Then newly elected ASB Executive Council and Director, Student Activities may decide it necessary to bring in third parties to assist, other than officers prior said, with the selection of commissioners. The third party must be in attendance for the full session of process.
Amendment III
If an elected ASB officer leaves the school during their term, an interview shall take place to fill that position. Any person who ran for any executive ASB office and was not elected will be allowed to be interviewed for the open position. The interview panel shall consist of the elected ASB Executive Council and Director, Student Activities.
Amendment IV
No amendments or minor changes can be made to the ASB Constitution unless there is a 2/3 vote of approval in the ASB Cabinet.
